Terms of Service

These Terms of Service (“Terms”) govern your use of the services, website, reports, communications, and related offerings provided by Alicante Home Inspection (“Company,” “we,” “our,” or “us”). By scheduling, purchasing, accessing, or using our services, you (“Client,” “you,” or “your”) agree to these Terms.
If you do not agree to these Terms, you must not use our services.
1. Company Information
Alicante Home Inspection provides residential property inspection services, visual assessments, reporting, and related consultation services for clients purchasing, selling, leasing, managing, or evaluating real estate properties.
All inspections are subject to the limitations, exclusions, and conditions outlined in these Terms and in any inspection agreement, estimate, invoice, report, or written communication provided by the Company.
2. Scope of Services
Our inspections are limited visual inspections of reasonably accessible areas of the property at the time of inspection.
Unless otherwise expressly stated in writing, inspections:
- Are non-invasive and non-destructive
- Are performed based on visible and accessible conditions only
- Are not technically exhaustive
- Do not guarantee future performance or condition of systems or structures
- Do not constitute engineering, architectural, legal, insurance, environmental, or code compliance evaluations
- Do not guarantee that all defects, hazards, or deficiencies will be discovered
Inspection findings reflect the observable condition of the property only at the time and date of inspection.
3. No Warranty or Guarantee
Alicante Home Inspection makes no warranty, representation, or guarantee, express or implied, regarding:
- The future condition of any property
- The continued functionality of systems or components
- Compliance with local building codes or regulations
- Habitability or investment suitability
- Hidden, latent, concealed, or inaccessible defects
- Mold, asbestos, lead paint, radon, pests, water contamination, or other environmental hazards unless specifically contracted in writing
All services are provided on an “as-is” and “as-available” basis.
To the fullest extent permitted by law, all implied warranties, including warranties of merchantability and fitness for a particular purpose, are expressly disclaimed.
4. Client Responsibilities
The Client agrees to:
- Provide accurate property and contact information
- Ensure reasonable access to the property
- Obtain permission from owners, tenants, agents, or occupants where required
- Review all inspection reports promptly upon receipt
- Seek specialist evaluations where recommended
- Use the inspection report solely for informational purposes related to the inspected property
The Client acknowledges that failure to follow specialist recommendations may increase risk and limit the usefulness of the inspection.
5. Inspection Reports
Inspection reports are prepared exclusively for the Client identified in the inspection agreement.
Reports:
- Are confidential unless shared by the Client
- Are not transferable unless expressly authorized in writing
- Must not be altered, modified, or partially reproduced
- Reflect professional opinions based on visible conditions at the time of inspection
Any unauthorized reliance on a report by third parties is done entirely at their own risk.
Alicante Home Inspection assumes no liability to third parties who access, review, receive, or rely upon inspection reports without our express written authorization.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Alicante Home Inspection, its owners, employees, contractors, affiliates, agents, and representatives shall not be liable for:
- Indirect, consequential, incidental, special, or punitive damages
- Lost profits, loss of opportunity, or emotional distress
- Property devaluation or business interruption
- Repair costs exceeding the inspection fee paid
The total aggregate liability of Alicante Home Inspection for any claim, dispute, or cause of action arising from the inspection or related services shall not exceed the total amount actually paid by the Client for the inspection service.
7. Time Limitation for Claims
Any claim, dispute, lawsuit, demand, or legal action arising out of or relating to the inspection, report, website, or services must be commenced within one (1) year from the date of the inspection. Failure to initiate action within this period constitutes a complete waiver and bar to any claim.
8. Mandatory Notice and Opportunity to Reinspect
Before initiating any claim, the Client agrees to:
- Provide written notice describing the alleged issue;
- Allow Alicante Home Inspection a reasonable opportunity to reinspect the property before any repairs are performed; and
- Permit access to all relevant documentation and evidence.
9. Excluded Items and Services
Unless specifically agreed to in writing, inspections do not include engineering analysis, structural calculations, code compliance, environmental testing, mold, asbestos, lead, radon, sewer scope, pest/termite, or pool inspections unless added as a separate service.
